Residents Fumed Over Weekend Alcohol, Firearm Ban
King State Of Emergency Lifted Monday

POSTED: 5:18 pm EST February 6, 2010
UPDATED: 4:08 pm EST February 8, 2010

KING, N.C. -- Residents in King were fumed over the weekend after a state of emergency declaration restricted the sale of alcohol and the carrying of firearms in vehicles.

King Police Chief Paula May said she’s received hundreds of threats related to the restrictions, which banned driving from 12 a.m. Sunday to 5 a.m.

The state of emergency for King was declared by members of the City Council after Stokes County authorities also declared a state of emergency.

Under North Carolina law, May said, when a state of emergency is put into place that includes a ban on driving, the sale of alcohol and carrying of firearms in vehicles is also banned.

“I think there’s been some misinterpretation that I personally have declared martial law and taken away people’s right to bear arms and that’s erroneous,” May told WXII reporter Jermont Terry. “By law, statue 14-288.7 automatically went into effect. And that law which goes into effect when there’s a state of emergency prohibits the transportation, purchase sale and possession of fire arms other than on ones own premises.”

The news of the ban created a firestorm of criticism.

More on this Story

What does Alcohol, Guns and the right to freely move about has ANYTHING to do with a snowstorm?

Especially the right to sell and buy guns, two Un-Constitutional restrictions have happened here, and the Police knew better than to issue Any tickets because they knew if they did this law would have been challeneged on its UnConstitutionality.

Laws like this MUST be tossed, 'we the people' have the Constitutional right to our firearms, and the right to be able to freely move about.

They may say this isnt a declaration of Martial Law, but in all respects it IS a Declared Martial Law imposed on the people of that area, Un-Constitutionally.

Banning the ability to carry your firearms in your vehicles or the sale or buying of firearms is patently and completely Un-Constitutional and restricting peoples right to freely move about without a seriously good reason is Also Un-Constitutional.

I so hope someone challenges that law before its used again anytime soon, it needs to be done away with.

I also think the Libs made a trial run using this kind of law to see just how the people would react and respond to it.

I'm sure if there ever was a National Emergency they prolly would clamp down on our Constitutional rights so fast it would make your head spin, with laws such as this.

Sorry but to impose a de-facto Martial Law over a snowstorm i.e. bad weather is a seriously lame excuse to do a trial run on a law that should have never seen the light of day or been crafted and passed at all.

Isaiah Ch 40 - v31. But they that hope in the Lord shall renew their strength, they shall take wings as eagles, they shall run and not be weary, they shall walk and not faint.

25 And behold a certain lawyer stood up, tempting him, and saying, Master, what must I do to possess eternal life?

26 But he said to him: What is written in the law? how readest thou? 27 He answering, said: Thou shalt love the Lord thy God with thy whole heart, and with thy whole soul, and with all thy strength, and with all thy mind: and thy neighbour as thyself. 28 And he said to him: Thou hast answered right: this do, and thou shalt live. 29 But he willing to justify himself, said to Jesus: And who is my neighbour? 30 And Jesus answering, said: A certain man went down from Jerusalem to Jericho, and fell among robbers, who also stripped him, and having wounded him went away, leaving him half dead.

31 And it chanced, that a certain priest went down the same way: and seeing him, passed by. 32 In like manner also a Levite, when he was near the place and saw him, passed by. 33 But a certain Samaritan being on his journey, came near him; and seeing him, was moved with compassion. 34 And going up to him, bound up his wounds, pouring in oil and wine: and setting him upon his own beast, brought him to an inn, and took care of him. 35 And the next day he took out two pence, and gave to the host, and said: Take care of him; and whatsoever thou shalt spend over and above, I, at my return, will repay thee.

36 Which of these three, in thy opinion, was neighbour to him that fell among the robbers?
37 But he said: He that showed mercy to him. And Jesus said to him: Go, and do thou in like manner.

I think this was a trial run to see if they could get away with it.

Thats why I think the cops never issued any tickets due in large part on the Un-Constitutionality of this 'emergency Powers'

As it is this kind of thing is dangerous and needs to be scrutinied more thoroughly.

People from every state should look into their state laws as well as county and local laws concerning 'Emergency declaration laws' and what they do to ones liberties.

I dont think much of using a snowstorm to exercize something that on the top is Constitutionally illegal.
