Over recent days there have been complaints raised about alleged abuse of the ConservaBabe policy concerning the observance of the Fair Use and Credit provisions governing the posting of copyrighted material in our forums. After obtaining a few links to reported abuse and having the time to view and analyze their veracity, I think the problem can best be solved by clearly stating our policy and trusting members to adhere to it. The administration sincerely hopes that any "corrective action" can be avoided through better member understanding. We here at CB pride ourselves in our largely "hands-off" style of management which maximizes the exercise of free speech and camaraderie among our members. When we do have to intercede we try to do so in the least intrusive, least punitive manner appropriate to a desired solution.

This is one of those times. Please, if you do not understand the following instructions, do not hesitate to contact a board administrator for direction and answers to any questions you may have in that regard.

Fair Use and Credit is no joke. It is a SERIOUS legal matter which has the potential of landing ConservaBabes.Com in a world of trouble... even involvement in legal actions and possible damages. ConservaBabes owners and the admin team take this matter to be as serious as a heart attack. We also unequivocally respect the rights and interests of anyone putting their talents in words under the provisions of copyright protection. It is STRICTLY ILLEGAL to copy (or post) written material, which is the intellectual property of the original writer, in it's entirety, unless YOU are the direct recipient of said material WITH permission to repost or otherwise forward or disseminate same. However, it is legal, fair and reasonable for you to quote or repost small segments of an article or other written works in the form of "excerpts" in order to alert others about it's importance, to make reference to your original point of interest or to encourage others to read the original piece in the interest of education or supporting reference. The rule is that you MAY NOT use more than 40% (we prefer no more than 25%) of the piece including written words, videos, descriptions and/or pictures in your exercise of said fairness of use, AND you MUST provide an embedded link to the original source (publisher), identifying the author, which is VERY PROMINENTLY DISPLAYED at the beginning or end of your post in any subject thread. There are some caveats to this. For instance, you obviously cannot post that percentage of a book, research paper, dissertation or masters' thesis. Failure to observe the FUCA is actionable in a court of law and can be considered plagiarism or theft of intellectual property, regardless of your intent or any misunderstanding of those who read your post, within a thread. Additionally, it is incumbent upon the owners/managers of our board to "police" illegal practices which violate copyright laws. We are obligated to discipline abusers of the FUCA provisions, even to the point of suspending posting privileges or outright banning of offenders in order to demonstrate the fact that we do not allow or condone such violations of the law. In fact, in some cases we may even be obliged to report "repeat offenders" to authorities for possible prosecution according to the law.

Now that this policy has been clearly and prominently laid out for all members, you violate our intent at your own peril. We encourage free speech to the highest degree, but we insist on the protection of the property of others under the FUCA. Please do not ignore or test our resolve in this matter. Your membership here is highly valued and respected. Please extend to us that same value and respect by adhering to policy.

Just in case you're wondering, brother, this had nothing to do with you or any serious breeches of decorum here. It was simply put together to end a couple of minor spats by putting it out in clear language. In no way was it meant to change or stop anyone's propensity or freedom to post as usual as long as we all follow the rules and keep Cbabes from liability and folks from arguing amongst one another.

What someone? I post only stories I feel are relevant to the day, or relevant to talk, discuss or debate about.
